1. PetAbet.com (SM) is owned and operated by 123Give, LLC, which reserves all rights relating to PetAbet.com, including but not limited to those rights afforded by applicable service mark and copyright laws. 123Give, LLC, may also be referred to herein as PetAbet.com.
2. When a visitor purchases goods and services from a merchant listed on this website (which list may be referred to as "Merchant Menu"), those purchases generate fees that are paid to PetAbet.com, which, following its receipt of the fees, donates a portion of them to Animal Welfare Organizations ("Organizations") dedicated to helping needy animals. Some inherent processing delays exist between the time of the fee-generating purchase and the date the merchant makes payment to PetAbet.com. The merchants, not PetAbet.com, determine when fees are paid. PetAbet.com must wait until any applicable buyer-return-period expires before donating any portion of the fees generated from that buyer's purchases. While most merchants make payments monthly, some make payments quarterly. One should expect a lag-time of approximately seventy-five days between fee-generating purchases and the receipt of donations based upon those purchases. PetAbet.com makes donations monthly; therefore, once the initial seventy-five day period elapses, an Organization will receive donations on a monthly basis, assuming that visitors are regularly making purchases for that Organization's benefit. In instances where an Organization is due a donation of less than twenty dollars in any given month, PetAbet.com reserves the right to withhold making the donation until twenty dollars or more is due.
3. PetAbet.com does not obligate itself to list an Organization on its website. At PetAbet.com's sole and absolute discretion, PetAbet.com may deny at any time any request to list an Organization on its website, and may, in its sole and absolute discretion, withdraw at any time and without notice such a listing after it has been made.
4. PetAbet.com is not a party to any contract, agreement or arrangement, whether express or implied, between a buyer of goods or services through PetAbet.com's Merchant Menu and the merchant providing those goods or services. All financial arrangements and obligations, credit terms, delivery and payment terms, warranties, guarantees, and representations as to quality of goods and services purchased, fitness of purchased goods and services for a particular purpose, timeliness or security of delivery, and all other terms, conditions, responsibilities and liabilities related to the goods and services purchased through PetAbet.com's Merchant Menu are solely and exclusively between the buyer of goods and services and the merchant providing those goods and services.
PETABET.COM AND 123GIVE, LLC, MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND AS TO THE AVAILABILITY, QUALITY, SAFETY, FITNESS FOR A PARTICULAR USE OR PURPOSE, SHIPMENT, DELIVERY OR CONDITION OF ANY GOODS OR SERVICES PURCHASED THROUGH PETABET.COM'S MERCHANT MENU, AND EXPRESSLY DISCLAIM ALL LIABILITY FOR BODILY INJURY, PROPERTY DAMAGE OR DEATH ARISING FROM THE USE OF ANY GOODS AND SERVICES PURCHASED THROUGH PETABET.COM'S MERCHANT MENU, ALL SUCH WARRANTIES, REPRESENTATIONS AND LIABILITY BEING EXPRESSLY DISCLAIMED BY PETABET.COM AND 123GIVE, LLC, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. Any litigation relating in any manner to this website and/or the services provided by PetAbet.com and/or 123Give, LLC, through this website shall be filed in the North Carolina State Courts, which shall apply North Carolina State law, and which shall be deemed the only courts with jurisdiction over such case.

PetAbet.com is not responsible for the following: (a) a merchant's failure to pay PetAbet.com; (b) a merchant's failure to honor its published sales, discounts, promotions or coupons; (c) errors or technical difficulties of any third-party responsible for tracking purchases and calculating fees under PetAbet.com's agreement with any merchant; (d) inadvertent coding, scripting, or linking errors; and (e) typographical errors or inadvertent misrepresentations in any regard.

If inadvertent coding, scripting or linking errors result in PetAbet.com's not being able to credit generated fees to a selected Organization, PetAbet.com will credit those fees to the default Organization, which at present is Animal Legal Defense Fund, and is subject to change at PetAbet.com's sole and exclusive discretion.
8. PetAbet.com assumes no liability for problems associated with technical difficulties or failures, regardless of their cause or effect, nor will PetAbet.com incur any liability whatsoever due to Acts of God, riots, civil disorder or unrest, acts of war, labor or materials shortages or unavailability of goods.
9. PetAbet.com does not provide legal, tax, or financial planning advice and nothing contained in this website should be construed as such. Visitors should seek the advice of competent, licensed legal, accounting and financial planning professionals in their jurisdiction for advice and direction as to whether the purchase of any goods or services through PetAbet.com's Merchant Menu may have any personal or business-related tax or financial planning advantages or benefits.
10. PetAbet.com reserves the right to modify the amounts of donations and/or the method by which it calculates them, at any time. Any such modifications will be posted on this website.
11. In rare instances, a purchase made after clicking through PetAbet.com's Merchant Menu may not qualify to earn a donation. These instances are based upon decisions made by the merchants and are outside of PetAbet.com's control.
